PURCHASE AGREEMENT

TheThreeWiseMonkeyLLC

Effective Date: June 2025

This Purchase Agreement (“Agreement”) is entered into between TheThreeWiseMonkeyLLC, hereinafter referred to as “Seller,” and the individual or entity purchasing an animal, hereinafter referred to as “Buyer.” By placing a deposit, submitting payment, or otherwise engaging in a transaction, the Buyer acknowledges, understands, and agrees to the following terms and conditions.

1. LEGAL ELIGIBILITY AND COMPLIANCE

1.1. Legal Ownership Responsibility

Buyer is solely responsible for verifying that the ownership of exotic animals is legal in their local jurisdiction, including city, county, state, and federal laws.

1.2. Permits and Licenses

If applicable, Buyer must obtain all required permits or licenses before pickup or transport. No refunds shall be issued due to legal ineligibility, permit denial, or ownership restrictions discovered after payment.

1.3. Failure to Comply

Failure to meet legal requirements will result in forfeiture of deposits and all prior payments.

2. DEPOSITS AND PAYMENT TERMS

2.1. Nonrefundable Deposits

All deposits are nonrefundable and nontransferable. An animal is not reserved until the deposit is confirmed by Seller.

2.2. Accepted Payment Methods

• Exact-change cash

• Zelle

• CashApp

A maximum of two (2) payment methods may be used per transaction (excluding the deposit).

2.3. Final Payment Deadlines

• Local Pickup: Balance due in cash at pickup, or electronic payment cleared 24 hours in advance.

• Transported Animals: Balance due 7 days before scheduled transport.

2.4. Cancellation and Forfeiture

Cancellations initiated by Buyer will result in forfeiture of all payments.

All payments made toward neutered animals are nonrefundable.

False or misleading information provided by Buyer will void all payments and result in cancellation of sale.

3. HEALTH GUARANTEE

3.1. Mandatory Veterinary Inspection (72-Hour Rule)

Buyer is required to have the animal examined by a licensed exotic animal veterinarian within seventy-two (72) hours of receipt, regardless of whether the animal is picked up in person or received via transport. Failure to complete this veterinary inspection within the stated time frame will result in the immediate forfeiture of all health guarantees provided herein.

3.2. Health Condition at Time of Sale

Seller certifies that, at the time of transfer, each animal is in good health, free from visible signs of illness, and exhibiting appropriate behavior and feeding independently. Seller further confirms that the animal has been cared for in accordance with USDA standards and applicable animal welfare regulations.

3.3. Notification of Health Concerns

Should the Buyer’s veterinarian identify a medical condition believed to be pre-existing and originating prior to the Buyer’s receipt of the animal, the Buyer must submit a written veterinary report with full findings to Seller within three (3) calendar days of the exam. Failure to do so waives all rights to dispute the health of the animal or seek remedy under this guarantee.

3.4. Conditions for Replacement

If the above conditions are met, and the diagnosis is confirmed to be a pre-existing, congenital, or infectious issue present prior to Buyer possession, Seller agrees to offer a replacement animal of equivalent species, sex, and comparable value, subject to availability. The original animal must be returned to Seller within three (3) calendar days of diagnosis in the same condition in which it was received.

3.5. Limitations and Exclusions

This Health Guarantee does not apply under any of the following conditions:

• The Buyer fails to obtain a veterinary inspection within seventy-two (72) hours.

• Illness is contracted after possession or due to environmental exposure.

• Animal has been housed with other pets or exotic species post-sale.

• Animal has been altered, injured, neglected, or mishandled.

• Buyer used an unauthorized third-party transporter.

3.6. Extended Genetic Guarantee

Seller provides a one (1) year guarantee against hereditary or congenital defects that materially affect the animal’s quality of life. Buyer must provide documented diagnosis from a licensed exotic animal veterinarian. Seller reserves the right to verify all claims and offer remedy by way of refund, partial refund, or replacement, not to exceed the original purchase price.

4. PICKUP, BOARDING & TRANSPORT

4.1. Release Conditions

Animal will only be released upon proof of an approved habitat and when:

• Animal reaches healthy weight

• Is stable

• Is feeding independently

4.2. Rescheduling

Pickups should occur within seven (7) days of the “ready by” date.

Reschedules beyond this period require:

• Full payment by original date

• Payments become nonrefundable

• Prepaid daily boarding fee

4.3. Boarding Fees

Per animal, per day:

• $40/day – Bottle-fed (no overnight feedings)

• $80/day – Monkeys or bottle-fed with overnight care

Boarding fees are nonrefundable and must be prepaid.

5. RETURNS AND REHOMING

5.1. No Unauthorized Transfers

Animals may not be sold, gifted, or rehomed without prior written consent from Seller.

5.2. Voluntary Returns

If Buyer can no longer keep the animal, it must be returned to Seller at Buyer’s expense. A partial refund may be issued:

• 50% within 7 days

• 25% within 14 days

5.3. Conditions for Refund

Animal must be healthy and unaltered (if sold as such). No refunds after 14 days. Buyer may still surrender animal for rehoming.

5.4. Nonrefundable Items

No refund will be issued for:

• Deposits

• Boarding fees

• Veterinary costs

• Transport/shipping

• Photoshoot fees

• Supplies or food

6. BREEDING POLICY

6.1. Pet-Only Agreement

All animals are sold strictly as pets. Breeding, resale, exhibition, or commercial use is strictly prohibited.

6.2. Legal Enforcement

Violation of this clause constitutes breach of contract and may result in legal action.

6.3. Federal Law Compliance

Cotton-top tamarins are protected under the Endangered Species Act. Breeding and resale of these species without a USDA license is prohibited by federal law. TheThreeWiseMonkeyLLC does not sell breeding animals.

7. SPECIES-SPECIFIC RESTRICTIONS

7.1. Cotton-Top Tamarins (Florida Only)

Due to federal regulations, we only sell cotton-top tamarins to residents of Florida.

Valid Florida ID must be presented before purchase.

Failure to provide such ID will result in cancellation and forfeiture of deposits.

8. MEDIA AND PHOTOSHOOTS

8.1. Standard Media

Each animal receives two photo sets:

• At time of listing

• Prior to release

8.2. Optional Photoshoots

Upon request:

• $15 for 5 additional photos

• $20 for 5 photos + 1 video

Media delivered within 3 business days of payment.

9. ACKNOWLEDGMENT & SIGNATURE

Buyer acknowledges that they have read, understood, and agree to abide by the terms outlined in this Agreement. By submitting a deposit, payment, or engaging in any form of purchase, Buyer is entering into a binding contract with TheThreeWiseMonkeyLLC.

Common items in a terms and conditions agreement allow you to:

• Withdraw and cancel services, and make financial transactions.
• Manage customer expectations, such as liability for information errors or website downtime.
• Explain your copyright rules, such as attribution, adaptation, commercial or non-commercial use, etc.
• Set rules for user behavior, like forbidding unlawful behavior, hate speech, bullying, promotions, spam, etc.
• Disable user accounts.
• Write down any other terms or conditions that protect you or your audience.
